The WSIB looks for a number of things when the paper work arrives to establish a claim file, and based on some of the key information provided to them in the paper work, they will either say yes to paying benefits in your claim or they will say no. If they say yes, you will likely start receiving benefits and services immediately, but, if they deny your claim, they must provide you with a written decision outlining the reasons for doing so and informing you of the appeal "Time Limit", to objection to the decision. This is to be done in what they call, a timely manner.

These benefits are many and varied depending on your specific type of injury, disablement, or occupational or industrial disease(s). The nature and severity of your case always plays a significant role in how the WSIB will determine the type(s) of benefits and services you will receive, the duration for which they are to be paid, as well as the length of time that they will allow them for.

One thing is for sure, all benefits are based on medical documentation in your claim file.

Some of the most important things to look for when having an injury, disablement or developing an industrial disease or conditions are:

For work related injuries such as slip/fall/lift/twist ... etc:
- What happened?
- Did I report this accident?
- When?
- Who did I report this accident to?
- Did anyone see me have the accident?

For work related disablements such as repetitive strain conditions arising out of or in the course of my regular employment ... etc:
- What is my job?
- How long have I worked at this job?
- When did I first seek medical attention for this condition?
- What is my medical condition and could it be caused by what I do at work?
- Did I lose time from work because of this problem?
- How much time did I lose?
- Will I be able to go back to work if it keeps flaring up every time I go back and try to do my job?
- What if I go back to work but can't do my job anymore?
- What am I supposed to do?

For work related occupational or industrial diseases such as industrial asthma, white hands. asbestoses ... and the list goes on:
- Where do I work?
- What goes on there?
- How long have I worked there?
- What symptoms am I experiencing at work?
- Do they go away when I go home?
- How long have I had these symptoms?
- Did I lose time from work because of these problems?
- How much time did I lose?
- When did I first seek medical attention for this condition?
- What if I go back to work but can't do my job anymore?
- What am I suppose to do?
- What if I died from this disease?
- What would happen to my family?

How do I know if I got what I was suppose to get?

Unfortunately you don't!

As a matter of fact, for those of you who have had the unpleasant experience of dealing with this red-tape bureaucracy called the Workplace Safety & Insurance Board, or WSIB as it is currently known, you will be quite aware that the majority of the time it is very uncertain as to just what is going on with your claim?

You may also find it interesting to note that the only time the WSIB is really obligated to communicate with you in writing, is if an adverse decision has been made in your claim, and even then you may not be too surprised when you don't receive a letter in the mail from them denying something in your claim.

The best thing I can suggest to anyone who wants to be absolutely sure that the WSIB has processed their claim(s) properly and whether or not you have received all you are entitled to, is to have a review your claim(s) conducted as soon as possible.

I heard that the WSIB in Ontario Canada, is constantly making changes to the rules, so how do these changes affect me?

The Workplace Safety and Insurance Act, 1997 (WSIA), as it is currently known, continues to be amended from time to time. This came into effect with the implementation of Bill 99 Legislation, on January 1, 1998. Bill 99 has had both minor and major impacts on the way the WSIB will conduct their affairs.

Some of these changes include:
- Reduction of Temporary disability benefits or Loss of Earnings, to a maximum of 85% of net average earnings.
- Vocational Rehabilitation Services (also known as ESRTW, Early and safe return to work or LMR, Labour market re-entry and more recent WT, Work Transition)
- Re-Employment Rights and Obligations
- Workers' Co-operation Obligations
- Employers' Co-operation Obligations
- Future Economic Loss awards (FEL)
- Appeal Time Limits (never before in the history of the Compensation Board, Ontario)
- Survivors' Benefits Construction Workers and Employers
- Non-Economic Loss Awards (NEL), in recognition of a permanent impairment.
- NEL, Second Assessments
- NEL Lump Sum Payments
- Mental Stress Claims
- Mandatory Health Examinations
- Narcotic Medication Approval
